
Approval of installations in accordance with the Federal Immission Control Act
The construction and operation of production facilities (commercial or industrial) can have harmful effects on the environment. Permits are therefore required for certain facilities above a certain size.
In accordance with the Online Access Act (OZG), operators can apply online for the necessary permits under the Federal Immission Control Act (BImSchG).

Whether an approval procedure in accordance with the BImSchG is required for the construction or operation of your plant was determined by the legislator in the Ordinance on Installations Requiring Approval (4th BImSchV)(link is external).
You can find an overview of the approval of plants in accordance with the Federal Immission Control Act (BImSchG) on the website of the Thuringian State Office for the Environment, Mining and Nature Conservation (TLUBN)(link is external).
Depending on the type, capacity and size of your installation, Annex 1 of the 4th BImSchV(link is external) assigns it to a type of procedure for the approval process. For example, it is regulated there whether the application procedure must be carried out with public participation.
Changes to an existing installation approved in accordance with the BImSchG must be notified in accordance with § 15 BImSchG or, in the case of significant changes, a permit for the change must be applied for in accordance with § 16 BImSchG.
Procedure/deadlines
Competent authority
The responsibility for carrying out the notification and approval procedure in Thuringia is regulated by the classification of your installation in Annex 1 of the 4th BImSchV:

Procedure type V in column c of Annex 1 of the 4th BImSchV: The lower immission control authority of the city of Jena will accept your notification or application for processing.

Procedure type G in column c of Annex 1 of the 4th BImSchV: The TLUBN as the higher immission control authority in Thuringia will accept your notification or application for processing.
Since 01.07.2022, the ELiA software must be used in Thuringia for the preparation of notification and application documents. The software and instructions for using the software are provided by the TLUBN.
Procedure for preparing the application
- Download the ELiA software(link is external) to create the notification or application for approval of your installation in accordance with Sections 4, 15, 16 BImSchG
- Hand over the file(s) of the notification created with ELiA or the application created with ELiA to the competent authority (see above)
- If the competent authority is the lower immission control authority of the city of Jena, you will be redirected to the form for submitting the ELiA application(link is external) to the lower immission control authority in Jena.
