Details
Birth announcement
If the birth takes place in the University Hospital or in the Birth Center Jena, we receive the so-called birth announcement from these institutions. In the case of a home birth, the birth announcement must be made in writing within 7 working days by presenting the midwife's certificate.
The birth announcement bindingly states where and when the child was born. In this context, the parents state in particular what the child's first name(s) should be (-> Naming).
As soon as you have received the birth announcement, please come in person to the registry office to have the birth recorded. It may be necessary for both parents to be present.
Naming
The name of a German child consists of at least one first name and the family name. The exercise of the naming right is tied to the right of custody.
If the parents are married to each other, they have joint custody by law. If the parents are not married to each other, joint custody can be declared to the Youth Welfare Office.
If at least one parent is not a German citizen, it may be possible to choose a name that differs from the German name law. In this case, please be sure to inquire at the registry office.
First name
- The first name of the child is chosen by the parent with custody. If both parents have custody, both parents must agree on the first name of the child.
- Only those first names can be chosen which are also first names in their essence. If two first names are hyphenated, they become one first name.
- After notarisation in the registry office, subsequent changes are generally not possible. The choice of first name must not endanger the child's welfare.
Family name/birth name
- In the case of sole custody by the mother: In principle, the child receives the surname of the mother by operation of law. However, after paternity has been acknowledged, the child can also be given the father's surname (so-called name allocation).
- If the parents have joint custody: By law, the child has the married name of its parents as its maiden name. If the parents do not have a common surname, they must determine the surname of the child at the registry office for the first joint child (so-called name determination). This determination extends to all further joint children, provided that joint custody also exists for these.
Please note that both parents must be present at the registry office when a name is granted and when a name is determined. These two name declarations can also be made before the birth of the child.
Please also note that in principle both custodial parents must confirm the first name(s) for their child with a handwritten signature. If necessary, a confirmation of the first name of the parent with custody who is not present at the notarisation is therefore necessary.
Documents
All the certificates and documents listed below must be presented in the original for notarisation at the registry office. Foreign documents must always be translated by an interpreter accredited in Germany. We would like to point out that in special cases further documents may be required.
- Personal documents (identity card or passport) of mother and father
- Parents who are married to each other:
- Marriage certificate
- Birth certificates of both parents
- Parents who are not married to each other:
- Birth certificates of both parents
- Acknowledgement of paternity (if already made prenatally) and, if applicable, declaration of custody
If the marital status of the mother is "divorced" or "widowed", the marriage certificate of the dissolved marriage as well as the proof of the divorce of the marriage (final judgment) or the death certificate of the spouse must also be submitted.
