What needs to be considered?

The legal framework of urban planning law is often underestimated alongside building regulations. This primarily concerns the permissible structural utilization of land in accordance with the German Building Code, as follows:

  • may be built on this plot in principle,
  • how large may the building be?
  • where the building can be located on the plot and
  • what type of use (residential, offices, workshop, etc.) is permitted.

If the property/building in question is located within the scope of a legally valid development plan, the relevant framework conditions can be found in the planning regulations. Whether a property is located in a development plan can be viewed online in the map portal.

How can unnecessary effort and additional costs be avoided?

Before costly and time-consuming planning is commissioned, it is always advisable to briefly discuss the intended project with the staff of the urban development and planning law team. Verbal descriptions or initial sketches of the idea are usually sufficient. This allows potential problems to be identified at an early stage.

How is planning security increased?

The verbal information does not replace a legally binding decision by the planning permission authority. A building application does not have to be submitted to clarify fundamental questions; an application for a preliminary decision is also sufficient for individual issues. This does not necessarily require the involvement of an architect or planning office. An approved preliminary decision is valid for three years, so details can be planned in peace. This procedure helps to save costs and avoid unnecessary delays in the planning permission process.
