Appointment of a guardian - guardianship proceedings

Innerhalb der ihm zugewiesenen Aufgabenkreise unterstützt der Betreuer den betreuten Menschen bei der Entscheidungsfindung. Sowohl die betreute Person als auch der Betreuer sind unterschriftsberechtigt (Doppelzuständigkeit). Der Betreuer darf nur dann Vertreterentscheidungen treffen, wenn die betreute Person mangels freiem Willen nicht in der Lage ist, für sich zu handeln, ohne sich selbst erheblichen Schaden zuzufügen.

Suggestion of a guardianship procedure

A guardianship procedure can be initiated at the guardianship authority by any person, doctor, institution or association.

An affected person himself can apply for a guardian. For this purpose it is helpful if you already enclose a signed declaration of consent according to data protection law (see download).

Procedural steps of the guardianship court

The guardianship court instructs the guardianship authority to carry out an investigation of the facts and to draw up a social report. At the same time, an expert opinion is requested from a medical expert who has to examine the person concerned and draw up an expert opinion. The person concerned is informed in writing of the initiation of the procedure. If the person concerned is unable to communicate his or her will sufficiently to the guardianship court in the course of the proceedings, he or she must be assigned a guardian (Verfahrenspfleger) for these proceedings.

The last procedural step is the personal hearing by the guardianship judge.

Finally, either a guardian is appointed by a decision of the guardianship court or the guardianship is rejected.

You or your close relatives can appeal against the decision of the guardianship court.

The association Grenzenlos e. V. also advises on the initiation of guardianship proceedings. This association also takes over judicial guardianship. It is recognised as a "guardianship association".
