Details
Since 20.06.2019, the new 44th Ordinance on the Implementation of the Federal Immission Control Act (BImSchV) on medium-sized combustion, gas turbine and internal combustion engine plants has been in force. Procedure/Deadlines
With regard to the deadlines to be met, the 44th BImSchV distinguishes between existing installations and new installations.
Existing installations
Existing installations within the meaning of the Ordinanceplants are plants that were
- which were already in operation before 20.12.2018, or
- which were approved by 19.12.2017 in accordance with § 4 or § 16 of the BImSchG and were commissioned by 20.12.2018 at the latest.
Existing installations must be notified to the lower immission control authority of the city of Jena by 01.12.2023 at the latest.
New plants
New facilities, as defined in the ordinance, are facilities that. approved after 19.12.2017 or put into operation after 20.12.2018.
New installations must be notified immediately.
Plants under construction
Plants currently under construction must be notified prior to commissioning.
Documents
For the notification of an installation, the installation operator has a (notification form 44. BImSchV [PDF]).
In addition to the information pursuant to Annex 1 of the 44th BImSchV, the notification form also contains information on emission-relevant changes, a change of operator or the permanent decommissioning of a combustion plant. These changes must also be notified using this form.
The operator shall send the completed and signed notification form to the competent authority by

This registration is a transitional solution that will be used until a uniformuntil the implementation of a nationwide web-based application. is applied.
The lower immission control authority of the city of Jena carries out the notification procedure after the notification form has been returned and makes the information contained in the register of installations in accordance with the provisions on access to environmental information (Register of Installations 44. BImSchV [PDF]) on the website of the city of Jena. publicly accessible (§ 36 of the 44th BImSchV).
