Custody - apply for a negative certificate
Certificate according to § 58 SGB VIII (negative certificate)
The negative certificate serves as proof of sole custody for unmarried parents.
Details
If the parents of a child are not married to each other, the mother (provided she is not a minor) generally has sole custody.
§ Section 58 SGB VIII regulates information on sole custody from the custody register. This register is kept for children of unmarried parents and contains information if declarations of custody have been made or court decisions on custody have been made. If there is no entry, the unmarried mother can apply for written information (negative certificate) from the responsible youth welfare office.
The negative certificate (as proof of sole custody) can be requested from us free of charge.
