Childcare fees and parental fees - takeover

You can submit an application to the Family Service Team to have the childcare fees or parents' fees for daycare facilities (child daycare / kindergartens) paid in accordance with § 90 Para. 4 SGB VIII.

Families are entitled to the assumption or partial assumption of the costs for the use of a child daycare facility if they cannot reasonably be expected to bear the costs after determining the amount of income to be calculated according to a specific calculation scheme. This reasonable burden is determined by comparing the income and a burden limit.

Calculation of eligible income in accordance with §§ 82-84 SGB XII

The income of the child and the parents or the parent with whom the child lives must be taken into account for the determination. Income includes all amounts that "accrue" to the family. The income of other persons who are not biological parents but who live in the same household, for example in a marriage-like relationship, is not taken into account.

Income includes, for example, net earned income, net income from self-employment, BAföG/vocational training allowance (BAB), pensions, income from assets (interest income, rental income, etc.), sickness benefit, parental/maternity benefit, child benefit, maintenance payments, maintenance advance payments, housing benefit and ALG I.

Statutory or appropriate insurance contributions (e.g. household contents or liability insurance; without proof, a lump sum of €30.00 per adult is taken into account), contributions to the state-subsidized Riester pension and the necessary expenses associated with earning the income (e.g. travel costs to work - one way x €5.20 -, work equipment, contributions to professional associations) must be deducted from this income. In addition, maintenance payments up to the statutory amount can be taken into account as a special burden.

The income and the expenses claimed must be verified using suitable documents.

Determination of the burden limit according to § 85 SGB XII

The upper income limit is calculated from fixed amounts for the head of the household (basic amount, twice the standard requirement of level 1) and each additional family member (family allowance, 70% of the standard requirement of level 1) as well as the expenses for accommodation -> gross rent (cold rent + cold operating costs), taking into account the so-called upper rent limit.

This currently results in the following values on which a decision is based:

Assumption / partial assumption according to § 87 SGB XII

If the eligible income is below the income limit, the costs for the use of a day care center will be covered in full.

If the qualifying income is above the upper limit, 70% of the excess is to be paid as a so-called "personal contribution" via the family income. If the personal contribution does not fully cover the total claim, the excess amount is waived.

Application

The application must be submitted in writing to the FD Bürgerdienste, Team Familienservice, Engelplatz 1, 07743 Jena, 1st floor.

Deadlines

Costs can be covered from the month in which the application is submitted at the earliest. Retroactive coverage is not possible under any circumstances. In the event of approval, the decision is limited in time. The notification of approval contains a note indicating by when a follow-up application must be submitted. After the end of the approval period, there will be no further request to submit a follow-up application.

Required proof of income

  • Current gross income of the parent(s) (current payslip(s))
  • Self-employment of the parent(s) (tax assessment notice(s), business management analysis (BWA), income surplus calculation (EÜR))
  • Child benefit from the 2nd child (current proof, e.g. bank statement or similar - not older than 3 months)
  • Maintenance / advance maintenance payments (e.g. bank statement or similar)
  • Parental allowance / maternity allowance
  • BAföG / vocational training allowance (BAB) / scholarship (complete)
  • ALG I
  • Pensions (e.g. reduced earning capacity pension, disability pension, orphan's pension)
  • Other income in cash or cash equivalents

Required proof of expenses

  • Invoice from the daycare center stating the amount of the parental fee (only for independent providers who are not invoiced by the Family Service Team of the City of Jena)
  • Expenses for accommodation (basic rent + cold operating costs - rental agreement, current statement of operating costs, for residential property: proof of operating costs and, if applicable, interest and repayment schedule)
  • Maintenance payments (for children who do not live in the same household)
  • Insurance premiums (e.g. household contents or liability insurance, for voluntarily insured persons: health, nursing care and pension insurance)
  • Travel costs to work (monthly travel card, one-way distance to work in km and vehicle liability insurance)
  • Other expenses (e.g. contributions to the state-subsidized Riester pension, contributions to professional associations and costs for double housekeeping)
