Declaration of custody - joint custody
Parents who are not married to each other can declare joint custody of their child.
Details
A declaration of custody in accordance with § 1626a BGB enables parents who are not married to each other to obtain joint custody of their child.
The prerequisites for this are
- The parents of the child must not be married to each other at the time of birth.
- There must be no court decision on parental custody at the time of the declaration.
- The declaration can be made before the birth, often together with the acknowledgement of paternity.
Documents
- Valid identity card or passport
- Birth certificate of the child
- Certificate of acknowledgment of paternity
