Deviation from building and planning regulations

Wenn materielle Bau- und Planungsvorschriften nicht eingehalten werden können, sind hierzu Abweichungen innerhalb der Verfahren zu beantragen. Bei ansonsten verfahrensfreien Bauvorhaben ist dann ein förmliches Antragsverfahren als "isolierte Abweichung" zu beantragen.

As far as the procedure-free building projects mentioned in § 60 Thuringian Building Code (ThürBO) cannot be realized entirely in compliance with the applicable building and planning regulations, an application according to § 66 ThürBO with justification must be submitted for the deviations from the regulations.

Example

A garage in accordance with § 60 Para. 1 No. 1 b ThürBO, which does not comply with the necessary distance to the public traffic area (3.00 m) in accordance with § 2 Para. 1 ThürGarVO. The following could be cited as reasons

  • little used side street,
  • Installation of a radio-controlled garage door.

Insofar as deviations from neighbour-protecting regulations are to be made, neighbour participation is also required in accordance with § 69 ThürBO.

  • In addition to the deviation application with reasons, further building documents are regularly required for assessment in accordance with the building permit procedure.
