Monument law advice and information

The Lower Monument Protection Authority (Monument Protection Team) in the Building Regulations and Monument Protection Department provides advice on all questions relating to monument protection. This also includes questions about tax concessions and other funding opportunities.

Jena has a diverse landscape of monuments that has grown over the centuries. There are currently over 300 individual buildings, garden monuments, technical monuments and monuments of artistic culture in the current list of monuments. The list of monuments is an excerpt from the register of monuments of the Free State of Thuringia. This is updated and is subject to change with additions and disposals. The list of monuments of the city of Jena is available for download in the form of a map with a legend.

In addition, there are numerous ground monuments and monument ensembles, some of which comprise up to 250 individual objects.

In order to preserve the monument status of this rich inventory and at the same time ensure appropriate, contemporary use, it makes sense for owners to contact the Lower Monument Protection Authority at an early stage with regard to repair and alteration projects, as well as questions about preservation.

Cultural monuments

The Lower Monument Protection Authority maintains an excerpt from the Thuringian State Office for Monument Preservation and Archaeology's register of monuments for the city of Jena.

Where available, data on the monument status and history of the cultural monuments can be made available to the public in compliance with data protection regulations.

An object becomes a cultural monument if it fulfills the legal characteristics of a cultural monument. As the Free State of Thuringia (like most of the federal states) follows the informative system, no administrative act is required in Thuringia for the legally binding determination of monument status, as this exists by law (lat. "ipso iure").

The legal consequence of "monument protection" is therefore brought about by the legal definition itself. This makesit possible for previously undiscovered or unrecognized ground monuments, buildings and facilities to be listed.

As for those listed in the register of monuments, the free disposal of property guaranteed by the Basic Law of the Federal Republic of Germany is restricted, regardless of the knowledge of the respective owner. Monument status activates the social obligation of ownership.

Depending on the information requested, it may be necessary to submit suitable documents in the form of plans, photos and descriptions. Files relating to ongoing proceedings cannot be made accessible to uninvolved third parties.
