Certificate pursuant to Section 58 of SGB VIII (Negative Certificate)
The negative certificate serves as proof of sole custody for unmarried parents.
Details
If a child’s parents are not married to each other, the mother (provided she is not a minor) generally has sole custody.
Section 58 of Book VIII of the Social Code (SGB VIII) governs the provision of information regarding sole custody from the custody registry. This registry is maintained for children of unmarried parents and contains information on whether custody declarations have been submitted or court decisions regarding custody have been made. If there is no entry in the register, the unmarried mother may, upon request, receive written information (a negative certificate) from the responsible youth welfare office.
The negative certificate (as proof of sole custody) can be requested from us free of charge.
