3. purpose of data processing (Art. 13 para. 1 sentence 1 c) HS 1 DS-GVO)

Collection of data (including name, aliases, date of birth, nationality, parentage, etc.) of a foreigner for the purpose of carrying out a naturalization procedure and/or citizenship procedures.

The citizenship authority decides on naturalizations into the German state, the approval of the renunciation of German citizenship, the legal status as a German or German without German citizenship, the determination of the continued existence or loss of German citizenship of persons subject to declaration, the issuing of citizenship identity cards, identity cards on the legal status as a German or German without German citizenship and other certificates relating to German citizenship. In addition, the Citizenship Authority accepts declarations of German citizenship and provides information to persons obliged to make a declaration about their obligation to make a declaration of German citizenship and to retain a foreign citizenship as well as about possible legal consequences determined by law in this respect.

The legal basis for the processing activities (Art. 6 para. 1 letter E GDPR) is § 31 StAG, the Federal Central Register Act, the Registration Data Ordinance, the Residence Ordinance and, if applicable, corresponding international regulations.

5. recipients or categories of recipients (Art. 13 para. 1 sentence 1 e) DS-GVO

Your personal data will be transmitted to the Federal Office of Administration as the competent register authority for storage in the nationality register maintained throughout Germany. In addition, if necessary and permitted by law, your personal data will be forwarded to

  • Competent ministries of the federal states

  • Security authorities (immigration authorities, police, constitutional protection)
  • Social benefit providers incl. Bafög offices, maintenance advance, tax office

  • If necessary and legally permissible, your data will be passed on to the responsible authorities in your home country. Personal data according to Art. 4 No. 1 GDPR are data relating to the physical, physiological, genetic, psychological, economic, cultural or social identity of a natural person (date of birth, place of birth, country of birth, nationality, name, parents, parentage, marital status, disability, language skills, economic capacity, place of residence, rental costs, employer, partner, children, address, residence in the last 5 years, freedom from debt, health insurance, general insurance, passport information, residence permits, certificates, testimonials)

6. transfer to a third country or an international organization (Art. 13 para. 1 p. 1 f) GDPR)

In principle, there is no need to transfer your data to a third country or an international organization, unless it is absolutely necessary for the enforcement of nationality law. You must grant permission for this separately.

7 Duration of storage or criteria for determining the duration (Art. 13 para. 2 lit. a GDPR)

After collection from the citizenship authority, the data will be stored for the following period: 30 years after determination, acquisition or loss of German citizenship and 50 years for lists of issued citizenship certificates.

8 Rights of data subjects in the context of processing (Art. 13 para. 2 b) GDPR)

You have the right to information about your personal data and to the information listed in detail in Art. 15 GDPR.

  1. If your personal data is processed, you have the right to obtain information about the data stored about you by the nationality authority and its processing (Art. 15 GDPR)
  2. You have the right to have inaccurate personal data concerning you rectified and, if necessary, to have incomplete personal data completed (Art. 16 GDPR).
  3. If the legal requirements are met, you have the right to erasure of personal data concerning you if one of the reasons listed in Art. 17 GDPR applies.
  4. If the legal requirements are met (Art. 18 GDPR), you have the right to restrict the processing of personal data.
  5. You have the right to object to the processing of your data on grounds relating to your particular situation. (Art. 21 GDPR).
  6. If you have consented to the data processing or a contract for data processing exists and the data processing is carried out using automated procedures, you may have a right to data portability (Art. 20 GDPR).

9. right to lodge a complaint with a supervisory authority (Art. 13 para. 2 d) GDPR)

In the context of the processing of your personal data, you have the right to lodge a complaint with the supervisory authority pursuant to Art. 77 (1) GDPR. In Thuringia, this is the State Commissioner for Data Protection and Freedom of Information, Häßlerstraße 8, 99096 Erfurt.

10. legal or contractual obligation to provide the data (Art. 13 para. 2 e) DS-GVO)

You are obliged to provide your data. This obligation arises from: Section 31 of the Citizenship Act, the Federal Central Register Act, the Registration Data Ordinance and the Residence Ordinance. Anyone who provides incorrect or incomplete information on essential requirements for naturalization or uses it to obtain naturalization for themselves or another person (§42 StAG) will be punished with a prison sentence of up to 5 years or a fine and the revocation of naturalization.

11 Automated decision-making (Art. 13 para. 2 f) GDPR)

Your personal data will not be processed by means of automated decision-making, including profiling in accordance with Art. 22 (1), (4) GDPR.

12. further processing for another purpose (Art. 13 para. 3 GDPR)

Your personal data will not be further processed for a purpose other than that for which the data was collected.
