Redevelopment permit

In the redevelopment area, approval is required in accordance with Section 144 (1 and 2) of the German Building Code (BauGB), which includes redevelopment measures on buildings, the conclusion of land purchase agreements and fixed-term rental agreements, land charges and the creation of building encumbrances.

Measures requiring approval

Measures requiring approval pursuant to Section 144 (1) BauGB:

  • Construction, modification, change of use or demolition of buildings
  • Significant or substantially value-enhancing changes to land and buildings
  • transfer of use of a plot of land, building or part of a building under the law of obligations if it is entered into or extended for a limited period of more than one year
  • Transfer of use agreements

Projects requiring approval in accordance with § 144 Para. 2 BauGB are

  • the legal sale of a plot of land and the creation and sale of a heritable building right
  • the encumbrance of land (so-called rights in rem), unless they are connected with construction measures in line with the objectives of the redevelopment
  • the creation, amendment or revocation of a building charge
  • the division of a property

Notes on the application

The application for approval under redevelopment law in accordance with §§ 144, 145 BauGB for projects and legal transactions requiring approval must be submitted in writing to the Urban Redevelopment Department. The second page of the application form contains an information sheet on the documents to be attached to the application.

Approval under redevelopment law in accordance with §§ 144 / 145 BauGB does not replace

  • a building permit according to § 62 Thüringer BauO
  • a permit under monument protection law in accordance with Section 13 of the Thuringian Monument Protection Act

Both the building permit and the monument protection permit can be refused for reasons not related to redevelopment law.

After receipt of the complete application documents, the processing time for all measures for which a building permit is also required is 2 months, for all other measures or projects 1 month.

There is no charge for the issue of the renovation permit.

The special urban development law §§ 134 to 164 BauGB is a special right for urban redevelopment and development measures that is limited in terms of subject matter, space and time.
