Exemption from Building and Zoning Regulations

If specific building and planning regulations cannot be complied with, exemptions must be requested as part of the applicable procedures. For construction projects that would otherwise be exempt from procedural requirements, a formal application must then be filed as an “isolated exemption.”

To the extent that the non-permit-required construction projects referred to in § 63 of the Thuringian Building Code (ThürBO) cannot be fully implemented in compliance with the applicable building and planning regulations, an application must be submitted in accordance with § 73 ThürBO, including a justification, for any deviations from the regulations.

Example

A garage under § 63(1)(1)(b) ThürBO that does not maintain the required distance from a public traffic area (3.00 m) as specified in § 2(1) ThürGarVO. A possible justification in this case could be:

  • a rarely used side street,
  • installation of a remote-controlled garage door.

If a deviation from regulations protecting neighbors is to be made, the participation of neighboring parties is also required under § 76 ThürBO.

  • Request for an Exemption
  • In addition to the application for an exemption and its supporting rationale, additional construction documents are typically required for review, similar to those submitted in the building permit process.
