Division of land

Authorized persons can apply for a certificate stating that the division of the property meets the requirements of the Thuringian Building Code (ThürBO).

The division of a property does not (or no longer) require the approval of the building supervisory authority in order to be effective. However, upon request, the Building Regulations and Monument Protection Department will issue a certificate of compliance with public law regulations when dividing a property.

However, the division of a property may not create any conditions that contradict the ThürBO or the regulations issued on the basis of the ThürBO. This means that in the event of violations, the building supervisory authority cannot object to the division as such under procedural law, but can only take action against the unlawful consequences. This can be, for example, a building demolition order in the event of non-compliance with minimum distances.

The responsibility for compliance with building regulations in connection with the division of the property lies with the property owner and their appointed surveyor.

  • Application form (certificate of division)
  • Extract from the real estate map (cadastral map)
  • Floor plan drawings, views, sections, possibly photos of the existing building (only required if distances are not observed or in the case of border development)
  • Existing or necessary building permit entry § 90 ThürBO
  • Existing or necessary deviations according to § 73 ThürBO
  • Site plan (scale not smaller than 1:500) usually 1:250

The site plan should preferably be prepared by an ÖbVI and contain the following:

  • Property designation
  • Green areas, access road, parking spaces
  • Buildings and other structures
  • Dimensions, including property boundaries
  • Elevations of existing and planned terrain
  • Height classification of the structures
  • Spacing plan,
  • and distance area calculation
  • All supply and disposal facilities
  • B-plan stipulations, building encumbrances
  • Legend and title block
