- Assemblies do not require a permit. Freedom of assembly is guaranteed as a fundamental right in Article 8 of the German Basic Law (GG). However, assemblies / rallies in the open air must be registered.
- Planned demonstrations (processions) must always be registered.

Freedom of assembly
It is clear from Article 8(1) of the Basic Law that this is a civil right:
- All Germans have the right to assemble peacefully and without weapons without registration or permission.
- For assemblies in the open air, this right can be restricted by law or on the basis of a law.
Consequently, only German citizens can invoke Article 8 (1) of the Basic Law. Foreigners may assemble on the basis of the general freedom of action (derived from Art. 2 GG + Art. 11 ECHR).
Obligation to register for assemblies / rallies in the open air
Restrictions on the fundamental freedom of assembly arise primarily from the Assembly Act. The Assembly Act regularly stipulates a registration requirement for assemblies / rallies in the open air.
Demonstration (elevator)
Anyone intending to hold a demonstration (procession) in the open air must notify the assembly authority (Municipal Security Team) at least 48 hours before the announcement (Section 14 (1) VersG). Registration is therefore mandatory.
