Tree protection statute

The city of Jena has already issued a tree protection statute in 1997. This regulates in particular which measures are permissible on trees or under which conditions exceptions to the prohibitions of the statutes can be approved. It is to be applied to trees within the coherently built-up districts and within the area of application of development plans.

The application for an exemption is to be submitted to the lower nature conservation authority. The trees or woody plants in question are then inspected on site by a member of staff. In the case of difficult decisions, the tree protection commission or local district councils or local district mayors are involved.

The permit regulates the necessary preservation or protection measures and contains conditions for replacement plantings. In the case of tree felling in dense tree and grove stands or on properties with an above-average tree population, no replacement plantings are ordered.

Period for tree felling and pruning measures

For reasons of species protection, tree felling and pruning measures are only permitted from the beginning of October to the end of February and generally require the approval of the lower nature conservation authority.

The application for special permission (for tree felling: form under Downloads) must be submitted in writing or by e-mail to the lower nature conservation authority with the following information:

• Explanation of the planned measure
• District, plot, land parcel
• in the case of larger properties or construction measures, a sketch showing the location, species, height, trunk circumference and crown diameter.
