Demolition of Structures

Unless exempt from the permit process, the demolition of buildings and other structures must be formally reported to the Building Code and Historic Preservation Department at least one month prior to the intended demolition.

Note

Exemption from the permit requirement and the mere notification of demolition do not relieve the applicant of the obligation to comply with the requirements imposed on structures by public law regulations. The requirement to obtain other permits based on municipal ordinances (e.g., redevelopment or preservation ordinances) or other legal provisions (e.g., regarding environmental pollution control and historic preservation) remains unaffected.

Pursuant to Section 63(3) of the Thuringian Building Code (ThürBO), the demolition of buildings in building class GK 1 and detached buildings in GK 3, as well as of structures whose construction is also exempt under Section 63(1) of the ThürBO, does not require notification.

For non-detached buildings, the structural stability of adjacent buildings must be assessed by a qualified structural engineer as defined in Section 72(2) of the Thuringian Building Code (ThürBO) (specialist engineer for structural stability) and confirmed by signature on the notification form. Any supporting documentation that may be required serves solely for the purpose of civil liability assessment in the event of damage and does not need to be submitted to the building inspection authority.

The demolition notice merely informs the building inspection authority of the upcoming removal of a structure. In accordance with § 63(3) of the ThürBO, the Building Regulations and Historic Preservation Division does not process the demolition notice but merely checks it for completeness.

Any further necessary coordination, notifications, and the like with other specialized authorities—in particular the lower-level waste management authority and the lower-level historic preservation authority—are the sole responsibility of the building owner.

Regardless of whether notification is required or an exemption applies, a demolition survey form (statistics) must be submitted for all buildings to be demolished.

“Only” partial demolition is subject to the regular building permit procedure and is considered a renovation (-> see Building Permit).

The demolition notice for structures pursuant to § 63(3) of the Thuringian Building Code (ThürBO) must be submitted in one copy:

  • Notification form signed by the building owner and the structural engineer responsible for structural stability
  • Statistical survey form for materials removed
  • Excerpt from the cadastral map
  • Site plan marking the demolition site (usually outlined in yellow) with signature
  • Specification of the building class and a brief explanation (if necessary)
  • Elevations (existing drawings) or photos (if necessary)
