Demolition of buildings

The demolition of buildings and other structures must be formally notified to the Building Regulations and Monument Protection Department at least one month before the intended removal, unless the demolition is exempt from the procedure.

Note

The exemption from the procedure and the mere notification of demolition do not release from the obligation to comply with the requirements imposed on installations by public law. The requirement to obtain other approvals based on statutes (e.g. redevelopment or preservation statutes) or other legislation (e.g. immission and monument protection) remains unaffected.

In accordance with Section 63 (3) of the Thuringian Building Code (ThürBO), the demolition of buildings in building class GK 1 and free-standing buildings in GK 3 as well as structures whose construction is also exempt in accordance with Section 63 (1) ThürBO do not have to be notified.

In the case of non-detached buildings, the stability of the adjacent buildings must be assessed by a qualified structural engineer within the meaning of Section 72 (2) ThürBO (specialist planner for stability) and confirmed by signature on the notification form. Any evidence that may be required is only for the purpose of civil law assessment in the event of damage and does not have to be submitted to the building supervisory authority.

The demolition notification merely informs the building supervisory authority of the pending removal of a structure. In accordance with Section 63 (3) ThürBO, the Building Regulations and Monument Protection Department does not process the demolition notice, but only checks that it is complete.

The client is responsible for any further coordination, notifications, etc. that may be required with other authorities, in particular the lower waste authority and the lower monument protection authority.

Irrespective of the obligation to notify or exemption, a demolition survey form (statistics) must be submitted for all buildings to be demolished.

The "only" partial demolition is subject to the regular building permit procedure and is considered a conversion (-> see building permit).

The notification of demolition of structures in accordance with Section 63 (3) ThürBO must be submitted in 1 copy:

  • Notification form with signature of client and specialist planner for stability
  • Statistical demolition survey form
  • Extract from the real estate map
  • Site plan with marking of the demolition object (usually yellow overdrawing) with signature
  • Specification of building class and brief explanation (if necessary)
  • Views (as-built documents) or photos (if required)
