Settlement permit - EU permanent residence permit

The EU permanent residence permit (Section 9a of the Residence Act) is an unlimited residence permit. It is intended to give citizens from third countries that do not belong to the European Union a permanent right of residence in Germany. It entitles the holder to pursue gainful employment and is equivalent to a settlement permit.

The granting of an EU permanent residence permit is excluded if you hold a residence permit for humanitarian reasons, for education or if the purpose of your stay is temporary in nature.

The requirements are regulated in §§ 9a to 9c of the Residence Act. They are fulfilled if:

  • the foreigner has been living in Germany with a residence permit for 5 years,
  • his or her livelihood and that of his or her dependants, to whom he or she is obliged to provide maintenance, is secured by fixed and regular income (no receipt of public benefits under SGBII or XII),
  • the foreigner is permitted to work if he is an employee,
  • he/she has a permit to pursue his/her gainful employment on a permanent basis, if this is required (e.g. professional license, license to practice medicine, etc.),
  • they have fulfilled their tax obligations,
  • he or his spouse living together has made sufficient contributions to the statutory pension insurance or comparable insurance benefits (usually 60 months),
  • he and his spouse living together can provide evidence of contributions to health and long-term care insurance that are paid for an unlimited period or are automatically extended,
  • they have sufficient knowledge of the German language ("Deutsch-Test für Zuwanderer", Telc, Goethe or ÖSD certificate at level B1 of the CEFR) or have successfully completed a German-language university degree or German-language vocational training),
  • they have a basic knowledge of the legal and social order and living conditions in Germany ("Living in Germany" test or "Naturalization test" successfully completed),
  • there is no interest in deporting him/her (e.g. due to criminal offenses),
  • they have sufficient living space for themselves and their family members.

  • Proof of residence (tenancy agreement, in the case of a sub-tenancy agreement also a declaration of consent from the owner, in the case of use of own living space [property] extract from the land register)
  • Proof of health insurance
  • Proof of pension insurance (usually in the form of a pension insurance history from the German pension insurance)
  • Proof of financing (e.g. pay slip for the last three months and employment contract, for self-employed persons the last two income tax assessments and a current BWA/GUV)
  • Language certificate ("Deutsch-Test für Zuwanderer", Telc, Goethe or ÖSD certificate completed at level B1 of the CEFR) or a German-language university degree or German-language vocational training successfully completed [degree certificate])
  • Test "Living in Germany" or "Naturalization test"
  • "Certificate in tax matters" from the tax office
  • Signed instruction sheet
  • If applicable, declaration of consent to the storage and use of your e-mail address and telephone number
