Settlement permit - entitled to asylum or refugee status

In contrast to the residence permit, the settlement permit (§ 26 Para. 3 Residence Act) is an unlimited residence title. The granting of a settlement permit depends on the integration of the foreigner. It entitles the holder to pursue gainful employment.

The requirements are met if:

the foreigner

  • has been in possession of a residence permit as a person entitled to asylum or refugee for 5 years,
  • his or her livelihood is largely secure,
  • has sufficient knowledge of the German language ("Deutsch-Test für Zuwanderer", Telc, Goethe or ÖSD certificate at level A2 of the CEFR or has successfully completed a German-language university degree or German-language vocational training [final certificate]),
  • the Federal Office for Migration and Refugees has not initiated revocation or withdrawal proceedings,
  • there is no interest in deporting the foreigner (e.g. due to criminal offenses),
  • the foreigner is permitted to work, provided he/she is an employee,
  • the foreigner has a permit for the permanent exercise of his/her gainful employment, if this is required (e.g. professional license, license to practice medicine, etc.),
  • the foreigner has a basic knowledge of the legal and social order and living conditions in Germany ("Living in Germany" test or "Naturalization test"),
  • the foreigner has sufficient living space for him/herself and his/her family members.

The period of possession of the residence permit as a person entitled to asylum or refugee is reduced to 3 years if the foreigner has a command of the German language at level C1 (Telc, Goethe or ÖSD certificate of the CEFR or DSH 1) and their livelihood is largely secure.

All incoming applications will be reviewed without a personal visit.

  • Completed application form
  • Proof of identity (e.g. national passport, official documents with photograph, etc.)
  • Proof of residence (tenancy agreement, in the case of a sub-tenancy agreement also a declaration of consent from the owner, if using own living space [property] extract from the land register)
  • Proof of health insurance
  • Proof of financing (e.g. pay slip for the last three months and employment contract, for self-employed persons the last two income tax assessments and a current BWA/GUV)
  • Language certificate ("Deutsch-Test für Zuwanderer", Telc, Goethe or ÖSD certificate at least at level A2 of the CEFR or successful completion of a German-language university degree or German-language vocational training [degree certificate]),
  • Test "Living in Germany" or "Naturalization test"
  • Signed instruction sheet
  • If applicable, declaration of consent to the storage and use of your e-mail address and telephone number
