Settlement permit - skilled workers

In contrast to the residence permit, the settlement permit for skilled workers (Section 18c (1) AufenthG) is a permanent residence permit. It entitles the holder to pursue gainful employment.

The requirements are met if:

  • a skilled worker (with proof of a recognized foreign or German qualification) has been in possession of a residence permit in accordance with §§ 18a, 18b, 18d or 18g AufenthG for 3 years,
  • they can provide evidence of at least 36 months of contributions to the statutory pension insurance scheme or comparable insurance benefits,
  • they have sufficient knowledge of the German language ("Deutsch-Test für Zuwanderer", Telc, Goethe or ÖSD certificate at level B1 of the CEFR or have successfully completed a German-language university degree or German-language vocational training),
  • they hold a job that they are permitted to occupy in accordance with the requirements of Sections 18a, 18b, 18d or 18g AufenthG,
  • their livelihood is secured (no receipt of public benefits under SGBII or XII),
  • there is no interest in deporting them (e.g. due to criminal offenses),
  • the skilled worker is permitted to work if they are an employee,
  • they have a permit to pursue their gainful employment on a permanent basis, if this isrequired (e.g. professional license, license to practice medicine, etc.),
  • they have a basic knowledge of the legal and social order and living conditions in Germany ("Living in Germany" test or "Naturalization test") and
  • they have sufficient living space for themselves and their family members.

The period of possession of the residence permit is reduced to 24 months if the skilled worker has successfully completed vocational training or studies in Germany and can provide evidence of at least 24 months of contributions to the statutory pension insurance or comparable insurance benefits.

  • Proof of residence (tenancy agreement, in the case of a sub-tenancy agreement also a declaration of consent from the owner, in the case of use of own living space [property] extract from the land register)
  • Proof of health insurance
  • Proof of pension insurance (usually by means of a pension insurance history with the German pension insurance)
  • Proof of financing (payslip for the last three months and employment contract)
  • Language certificate ("Deutsch-Test für Zuwanderer", Telc, Goethe or ÖSD certificate completed at level B1 of the CEFR) or a German-language university degree or German-language vocational training successfully completed [degree certificate])
  • Test "Living in Germany" or "Naturalization test"
  • Signed instruction sheet
  • If applicable, declaration of consent to the storage and use of your e-mail address and telephone number
