Rent index for residential rents
The rent index provides information on the local comparative rent in accordance with Section 558 d of the German Civil Code (BGB). This reflects the rents usually paid for different types of apartments of a comparable type, size, furnishings, quality and location.
The rent index serves as a guide for tenants and landlords alike. It can protect tenants from unjustified rent increases and at the same time provides landlords with an overview of the rents usually paid.
In addition to naming three comparable apartments, an expert opinion and information from a rent database, it is one of the legal options for determining the comparative rent.
Current reference
The survey for the new rent index began in April 2025 and was successfully completed in June following a reminder campaign. The evaluation is currently taking place. It is planned that the new rent index will be available by the end of the year.
Details
The current rent index was recognized by the DMB Mieterverein Jena e. V., as an association representing the interests of tenants, and the Haus-, Wohnungs-, und Grundeigentümerverein Jena e. V., as an association representing the interests of landlords, on 20.10.2023 for the city of Jena. This recognition constitutes a qualified rent index in accordance with Section 558 d (1) BGB. It must be updated every two years and reassessed every four years. The qualified rent index has been valid for the city of Jena since 09.10.2013. The present rent index 2023 is an update in the form of a new survey and was carried out in accordance with Section 558 d (2) BGB on the basis of a random sample.

Scope of application
The rent index only applies to rented apartments in residential buildings with three or more apartments in the city of Jena, but not to detached and semi-detached houses. In addition, the following apartments are excluded from the rent index:
- Apartments that were subsidized with public funds and are therefore subject to rent and/or occupancy restrictions
- Apartments with commercially or partially commercially used rooms
- company, service or janitor apartments
- Fully sublet living space
- Apartments in homes and institutions in which additional services are provided by the landlord, e.g. meals, care, medical facilities
- Living space in accommodation similar to a home, e.g. in student or youth hostels
- Living space that is only rented out for temporary use
- Apartments for which a graduated rental agreement has been agreed
- apartments with temporary rental agreements and fixed rent agreements for a period of more than three years
- Apartments rented furnished or partially furnished
- Apartments whose kitchen, toilet and bathroom are shared by other tenants
- Apartments that are not equipped by the landlord with a bathroom, toilet and central heating
