Rent Index for Residential Rentals

The rent index provides information on the local comparative rent in accordance with Section 558d of the German Civil Code (BGB). This reflects the rents typically paid for various types of apartments that are comparable in type, size, amenities, condition (including energy efficiency), and location.

Current Note

The 2023 rent index has been updated using the consumer price index for net base rents in Thuringia and can be used as a general guide. 

It serves as a guide for both tenants and landlords. It can protect tenants from unjustified rent increases while also providing landlords with an overview of typical rent levels; in addition to listing three comparable apartments, the expert appraisal, and information from a rental database, one of the legal options for determining the comparable rent.

Scope of Application

The rent index generally applies only to rented apartments in buildings with three or more apartments within the city limits of Jena; it does not apply to single-family or two-family homes. In addition, the following apartments are excluded from the rent index:

  • Apartments that have received public subsidies and are therefore subject to rent and/or occupancy restrictions
  • Apartments with rooms used for commercial or partially commercial purposes
  • Worker, staff, or caretaker apartments
  • Living space that is fully sublet
  • Apartments in residential homes and institutions where the landlord provides additional services, such as meals, care, or medical facilities
  • Housing in residence-like accommodations, e.g., in student or youth dormitories
  • Residential space rented solely for temporary use
  • Apartments for which a graduated rent agreement has been concluded
  • Apartments with fixed-term leases and fixed rent agreements for a period exceeding three years
  • Apartments rented out furnished or partially furnished
  • Apartments whose kitchen, toilet, and bathroom are shared with other tenants
  • Apartments that are not equipped by the landlord with a bathroom, toilet, and central heating
